The petitioner is apprehending his arrest in connection with Piparwar P.S. Case No. 04 of 2026, registered for the offence under Sections 303(2), 317(2) and 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Chatra. 3. Learned counsel appearing for the petitioner submits that the allegations are made that from the Bolero vehicle, 03 jars of 40 liter diesel have been recovered. He further submits that the petitioner is not named in the FIR however, later on, name of the petitioner has surfaced as the petitioner is owner of the said Bolero vehicle. He also submits that the petitioner has got no criminal antecedent as disclosed in para 14 of the petition. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the petitioner happens to be the owner of Bolero vehicle. 5. Considering that name of the petitioner has surfaced as petitioner is the owner of the said Bolero vehicle and he has got no criminal antecedent as disclosed in para 14 of the petition and even the petitioner is not named in the FIR and in the attending facts and circumstances, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
