Ojha, Advocate ---- 2/17.04.2026 Heard learned counsel appearing on behalf of Petitioner and learned counsel appearing on behalf of the State. 2. The petitioner is apprehending his arrest for the offences registered under Section 8(c), 20(b)(ii) C and 29 of N.D.P.S. Act, in connection with Koderma (Rail) P.S. Case No. 11 of 2025, pending in the Court of learned Special Judge, NDPS Act Cum Sessions Judge, Koderma. 3. Learned counsel appearing for the petitioner submits that the name of the petitioner has come on the confessional statement of the apprehended co-accused, from whom 5.490 kg of ganja was recovered. He then submits that even the recovery of contraband is intermediary in quantity. He next submits that co-accused has been granted anticipatory bail in ABA No.6906 of 2025. 4. Learned counsel appearing for the State opposed the prayer and submits that the name of the petitioner has come on the confessional statement of the apprehended co-accused. 5. Considering that the name of the petitioner has come on the confessional statement of the apprehended co-accused, the recovery was not made from this petitioner, even the recovered contraband of intermediary quantity and the co-accused has been 2026:JHHC:11235 2 granted anticipatory bail in ABA No.6906 of 2025; I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner above named is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Principal District and Sessions Judge, Koderma, in connection with Koderma (Rail) P.S. Case No. 11 of 2025, subject to the condition as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. 7.
