The petitioner is apprehending his arrest in connection with Garhwa P.S. Case No.316 of 2025, registered for the offence under Sections 126(2), 115(2), 109(1), 89, 352 and 85/3(5) of the BNS and Section 3/4 of Dowry Prohibition Act, pending in the Court of the learned Chief Judicial Magistrate, Garhwa. 3. Learned counsel appearing for the petitioner submits that the petitioner is happened to be the husband. He further submits that false allegation is made against the petitioner of demand of dowry. He then submits that the petitioner has already filed a divorce case being Original Suit No.326 of 2025, in which, the wife has received notice on 07.07.2025 and, thereafter, present FIR has been lodged on 13.07.2025. 4. Learned counsel appearing for the State opposed the prayer and submits that the petitioner is happened to be the husband and in view of that, anticipatory bail may not be granted to the petitioner. Considering that after receiving notice in the said divorce case on 07.07.2025, the FIR has been lodged on 13.07.2025 and in that view of the matter, the petitioner is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions as the learned Court may deem fit and proper. 6.
