MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 24.04.2026
01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Nayapalli P.S. Case No.378 of 2023 corresponding to G.R. Case No.96 of 2023 pending in the court of learned J.M.F.C. (Cog. III), Bhubaneswar (earlier before the learned JJB-cum- P.M., Bhubaneswar) on the grounds stated. 3. Perused the FIR as at Annexure-1. The alleged incident has been narrated in the FIR. It is alleged therein by the informant that some unknown persons pelted stones at them and as a result, he received head injury. It is submitted to the Court by learned counsel for the petitioner that the injury is not grievous and that apart, the co-accused persons have been released on bail. The apprehension of arrest of the petitioner is on the basis of a disclosure made by the co-accused persons, as further submitted. It is informed to the Court that the chargesheet is filed in the meantime, hence, considering the p. 2 same, the petitioner, who is having no other criminal case, should be allowed to go on bail upon his surrender before the learned court below with any conditions imposed. Recorded the objection of the State. From the FIR, the Court find that the alleged mischief was committed by unknown persons. But the petitioner apprehends arrest in the hands of the local police in view of the confessional statements of the co-accused persons, who are stated to be on bail after being arrested. Since the incident is of the year, 2023 and in the meantime, there is closure of investigation, this Court, recording the claim that the petitioner has no antecedent and there is no serious injury caused to the victim during the alleged incident, is inclined to direct him to surrender before the learned court below for being released with conditions though it is not inclined to entertain his plea of pre-arrest bail moved by him. 4. Accordingly, it is ordered. 5.
In the result, the ABLAPL petition stands disposed of with a direction to the petitioner to surrender before learned J.M.F.C. (Cog.- III), Bhubaneswar (earlier before the learned JJB-cum- P.M., Bhubaneswar) within a fortnight from today and in the event, he surrenders in compliance thereof, shall be released on bail in connection with G.R. Case No.96 of 2023 arising out of Nayapalli P.S. Case No.378 of 2023 on furnishing a bail bond of Rs.25,000/- (rupees twenty-five thousand) with one solvent surety for the like amount to the satisfaction of the learned court below, which shall be at liberty p. 3 to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case. 6. Issue urgent certified copy of this order as per rules. (R.K. Pattanaik)
