The instant petition has been moved under Article 227 of the Constitution of India for expediting the proceeding of Civil Case No. 41 of 2018, Parmendra Mitra Sonkar vs. Dhanraj Sonkar & others pending in the court of Civil Judge (Jr. Div.) Haldwani, District Nainital. 3. It is argued by the learned counsel for the petitioner that the suit is pending since 2018 and almost more than 7-8 years have been passed but the same has not been decided so far. She also submits that earlier WPMS No. 2429 of 2018 was filed, which was disposed of finally on 27.10.2020 with the direction to the Trial Court to expedite the suit not beyond the period of nine months. It is further submitted that when the suit was not expedited a contempt petition was filed in 2018 which was also disposed of finally by directing the Trial Court to expedite the suit. She submits that despite two orders of this Court, i.e., in WPMS No. 2429 of 2018 and in CLCON No. 740 of 2018, the Trial Court has not expedited the suit. She also submits that even no application was moved in those petitions for seeking further time to expedite the either proceeding on an administrative side. 4. In such view of the matter, since twice this Court already directed to expedite the proceeding of the aforementioned suit, the present writ petition is disposed of finally with the direction to the learned Civil Judge (Jr. Div.) Haldwani, Nainital to conclude and decide the proceeding as expeditiously as possible preferably within three months from 2026:UHC:4337 the date of presentation of certified copy of this order.
