1. Heard learned counsel Mr. L. Gogoi for the petitioner Keshab Pokhrel who has filed this application under Section 483 of the BNSS, 2023 with prayer for bail as he is behind bars since 20.03.2026 in connection with Thelamara P.S. Case No. 17/2026 under Sections 69,77,351(3) of the BNS, 2923 R/W Section

2. Heard Ms. S. H. Bora, learned Additional Public Prosecutor for the respondent State.
3. Learned Additional Public Prosecutor has raised serious objection sating that this bail cannot be considered without perusal of the Case Diary considering the nature of allegations against the petitioner. It is also submitted that the petitioner has threatened the victim to upload certain private pictures taken by the petitioner.
4. I have considered the submission at the Bar.
5. It is submitted on behalf of the petitioner that the petitioner and the victim had a love affair and both the petitioner and the victim are engaged ad their marriage will be solemnized soon.
6. It is also submitted that the petitioner is willing to abide by any stringent bail conditions if imposed upon him.
7. Considering all aspects, it appears that bail may be granted to the petitioner. The petitioner is enlarged on bail on furnishing a bail bond of Rs. 30,000/- with a suitable surety of like amount to the satisfaction of the learned Jurisdictional Court/Elaka Magistrate under the conditions that: (i) The petitioner shall refrain from such activities with which he is alleged, (ii) The petitioner shall not exercise threats to the victim, and (iii) The petitioner shall not leave the jurisdiction of the Trial Court without prior permission.
8. On breach of any of the bail conditions, the Court is at liberty to
Page No.# 3/3 immediately cancel the bail granted to the petitioner.
9. In terms of the above observation, this bail application stands disposed of.
