Heard Mr. J. Ahmed, learned counsel for the applicant/petitioner. Also heard Mr. P. Borthakur, learned Addl. P.P., Assam appearing on behalf of the State respondent No.1. This is an application under Section 430(1)/(2) of the BNSS, 2023 for suspension of the sentence and to allow the petitioner to remain on previous bail, till disposal of the connected revision petition. order dated 22.12.2025 passed by the Addl. Sessions Judge No.1 Kamrup (M), Gauhati in Criminal Appeal No.100/2024 upholding the impugned judgment and
order dated 12.03.2024 passed by the learned Judicial Magistrate, First Class, Kamrup (M) at Guwahati in CR Case No.835C/2013, convicting the petitioner to pay fine of Rs.22,00,000/- and in default to undergo simple imprisonment for 6 (Six) months, till the disposal of the connected revision petition, the operation of the impugned judgment and order may be stayed/suspended and the petitioner may be allowed to remain on previous bail. Considering the submission made by the learned counsel for the applicant/petitioner, the operation of the impugned judgment and order, passed by the learned Judicial Magistrate, First Class, Kamrup (M) at Guwahati in CR Case No.835C/2013, which was upheld by the Addl. Sessions Judge No.1 Kamrup (M), Gauhati in Criminal Appeal No.100/2024 be stayed/ suspended till disposal of the connected revision petition. Further, the applicant/petitioner is also hereby allowed to remain on previous bail, till disposal of the connected revision petition. With the above observations, this interlocutory application stands disposed of.
