Learned counsel for the petitioner submits that the petitioner is in custody in connection with Kasmar P.S. Case No. 65 of 2025, corresponding to G.R. No. 47 of 2026, for the offences registered under Sections 126(2), 115(2), 69,351(2), 352/3(5) of the B.N.S. 2023 , pending in the court of learned Civil Judge, Sr. Division-((II-cum- Judicial Magistrate First Class, Bermo at Tenughat. 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and the petitioner is in custody since 29.11.2025 and victim is 22 years of age. 4. Learned counsel for the opposite party-State and the informant have opposed the prayer and has submitted that on the pretext of marriage, there was relationship between the parties for a period of 2 years and a child was also born. Initially, the application was made before the Marriage Registrar but ultimately the petitioner did not turn up for marriage. 5. After hearing the learned counsel for the parties and considering the direct nature of allegation against the petitioner, this ( 2026:JHHC:11028 ) 2 court is not inclined to enlarge the petitioner above named on bail.
