The petitioner was granted a patta in respect of the residential plot and has been in peaceful possession and enjoyment of the same. 2. The present writ petition has been filed challenging the action of the respondents in trying to dispossess the petitioner from the said land by demolishing the existing structure, without following the due process of law. Copies of the patta certificate and the Pattadar Pass Book have also been filed along with the writ petition. 3. Today, when the matter is taken up for hearing, there is no representation on behalf of the petitioner. However, having regard to the facts and circumstances of the case, the present writ petition can be disposed off by directing the respondents not to dispossess the petitioner from the subject property without following the due process of law. This direction shall, however, be subject to the condition that the respondents have not already taken any action in that regard prior to the passing of this order. There shall be no order as to costs.
