Tiwari, Advocate ---- 02/18.04.2026 Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State. 2. The petitioner is apprehending his arrest in connection with Cyber P.S. Case No.53 of 2025 for the alleged offences registered under Sections 61(2), 235, 319(2), 337, 338 and 340(2) of Bharatiya Nyaya Sanhita, 2023 and Section 66(D) of Information Technology (Amendment) Act, 2001, pending in the Court of learned Additional Sessions Judge-II-cum-Special Judge Cyber Case, Dhanbad. 3. Learned counsel appearing for the petitioner submits that the petitioner is already cooperating in the investigation. To buttress this argument, he refers to FIR itself and submits that it has been stated that the petitioner has cooperated and one Aman Kumar 2026:JHHC:11287 --2-- A.B.A. No. 1765 of 2026 Singh on offering Rs.1500/- to the petitioner has utilized the account of this petitioner. He further submits that so far Aman Kumar Singh and others are concerned they are absconding. He then submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.17 of the petition. 4. Learned counsel appearing for the State opposed the prayer and submits that allegations are there of syphoning of money of different persons and the matter is arising out of the cyber-crime. 5. In the FIR itself it has been stated that the petitioner on call by police has gone to the police station and investigation has already been done and petitioner has not been arrested by the police and he has stated that one Aman Kumar Singh instigated the petitioner by handing over Rs.1500/- and utilized the account of the petitioner and the petitioner has got no criminal antecedent as disclosed in paragraph No.17 of the petition and in that view of the matter the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
