1. Mr. Kaushal Sah Jagati, learned counsel for the petitioners.
2. Mr. Sandeep Sharma, learned A.G.A. for the State.
3. The petitioners are praying for adequate protection to their life and liberty since there is regular threat from respondent nos. 4 and 5, who are father and brother of petitioner no. 1. The petitioners are known to each other since last three years and are in love now have decided to marry with each other but since both belongs to the different religion the respondent nos. 4 and 5 are not ready for their marriage and now there is a regular threat from respondent nos. 4 and 5. In support of age, the Aadhar card has been enclosed.
4. The petitioner no. 1 made a complaint to the S.S.P., Nainital, with regard to threat from respondent nos. 4 and 5, the copy of which has been annexed as Annexure-3 at page 18.
5. Mr. Sandeep Sharma, learned A.G.A. have not disputed on their age and submits that both are major.
6. Since, now there is a regular threat to their life and liberty and the petitioner no. 1 made a written complaint to the S.S.P., let the S.S.P. may assess the threat perception, if any, from respondent nos. 4 and 5 and if he comes to the conclusion that there is threat, take appropriate steps.
7. In addition to this, the S.H.O. concerned shall call upon respondent nos. 4 and 5 and advise them not to take law in their hands.
8. At this juncture, it is relevant to mention here admittedly both the petitioners belongs to the different religion, however, the petitioner no. 1 submit an application to the District Magistrate that she intend to convert to Hindu religious faith, the copy of which is enclosed as Annexure-13,
2026:UHC:4425 therefore, the S.S.P. concerned may also examine this aspect and take appropriate steps to maintain law and order.
9. Subject to the observation and direction as above, instant the writ petition is disposed of finally.
