The Divisional Forest Officer vs. Bhag Singh CMP(M) No. 29 of 2026 Item No. S-8 07.01.2026 Present: Mr. Pranay Pratap Singh, Additional Advocate General, for the applicant. CMP(M) No. 29 of 2026 Keeping in view the averments made in the application, duly supported by an affidavit of Deputy Conservator of Forests, Suket Forest Division, Sundernagar, delay of 50 days’ in filing the appeal is condoned. The application stands disposed of. LPA No. 12 of 2026 and CMPST No. 1447 of 2026 Learned counsel for the State submits that the appointment of respondent was way back in the year 1998 and he was disengaged in 2002. While referring to the mandays chart (page No. 135) it is further submitted that respondent has worked for 41, 283, 79, 22 and 96 days respectively. In such circumstances he has been granted compensation having been employed on daily wage basis by the Labour Court of 75,000/-. ₹ Learned counsel for the State further submits that compensation could have been enhanced rather than directing the re-engagement after such a long period. Reference is also made to the order passed by us in LPA No. 136 of 2025, whereby a sum of 65,000/- has been awarded for every year ₹ of service. Keeping in view the above, we stay the operation of judgment of the learned Single Judge. In the meantime, the State shall deposit a sum of 65,000/-, for each year of ₹ service, with the Registrar General of this Court, before the next date of hearing.
