2. Mr. Narayan Dutt, Standing Counsel for the State of Uttarakhand.
3. Petitioner has challenged order dated 20.04.2026, whereby a sum of `3,72,344/- has been withheld from the amount payable as gratuity to him.

Perusal of the impugned order reveals that petitioner filed Writ Petition (S/S) No. 938 of 2026 challenging recovery of excess amount allegedly paid to him while, he was still in service; and in that writ petition, an interim order was passed on 09.04.2026 restraining the respondents from recovering any amount from the retiral dues.
5. Learned State Counsel submits that interim order was passed in that writ petition on 08.04.2026 and not 09.04.2026, as mentioned in the impugned order.
6. Be that as it may, since petitioner has challenged recovery of the amount allegedly paid in excess to him by filing a writ petition, which is still pending consideration, therefore,
2026:UHC:4454 another writ petition for similar relief would not be maintainable and the proper course for the petitioner would be to move application in the pending writ petition.
7. In such view of the matter, this Court declines to entertain this writ petition. The writ petition is dismissed with liberty to petitioner to move application in the pending writ petition.
