1. By way of this Criminal Misc. Petition under Section 528 of BNSS, the accused-petitioners have approached this Court with a prayer to quash the FIR No.499/2025 registered at Police Station
[2026:RJ-JP:12564] (2 of 3) [CRLMP-7945/2025] Vidyadhar Nagar, District Jaipur City (North) (Rajasthan) for offences punishable under Sections 318(4), 316(2), 338, 336(3), 340(2) & 61(2) of the Bharatiya Nyaya Sanhita, (in short ‘BNS’) 2023 (corresponding to Sections 420, 406, 467, 468, 471 & 120B of IPC) along with all subsequent proceedings arising out of the aforesaid FIR, on the basis of compromise arrived at between the parties.
2. Petitioner No.5 and complainant-respondent No.2, who are husband and wife, are present in person. They have duly been identified by their respective counsel.

Learned counsel for the petitioners submits that during pendency of the petition, matrimonial dispute between husband- petitioner No.5 and wife-complainant No.2 has amicably been resolved and they have mutually agreed to dissolve their marriage and they have already filed a joint petition under Section 13B of the Hindu Marriage Act, 1995 before the concerned Family Court seeking divorce by mutual consent. Counsel submits that due to compromise, further proceedings in the impugned FIR are fruitless and continuation thereof would be a futile exercise and a waste of precious judicial time and resources. Therefore, it is prayed that impugned FIR along with all consequential proceedings arising out therefrom may be quashed.
4. Learned Public Prosecutor places verification report dated 24.02.2026 received from the Assistant Commissioner of Police, Shastri Nagar, (North) Jaipur along with compromise-deed. According to which, parties have settled their dispute amicably.

Learned counsel appearing on behalf of complainant does not dispute the factum of compromise.

In view of the aforesaid and considering the submissions made on behalf of the respective parties; the material made available for perusal; considering the fact that parties have resolved their dispute amicably and also finding that the present case is wholly covered by the principle of law laid down by Hon'ble the Supreme Court in the case of Gian Singh versus State of Punjab & Anr. reported in 2012 Cr.L.J. (SC) 4934 and in the case of State of Haryana & Ors. versus Choudhary Bhajan Lal & Ors. reported in AIR 1992 SC 604, and as such, the aforesaid FIR is liable to be quashed in view of compromise arrived at between the parties.
7. In view of the above, this Criminal Misc. Petition is allowed and the FIR No.499/2025 registered at Police Station Vidyadhar Nagar, District Jaipur City (North) (Rajasthan) along with all subsequent proceedings arising out therefrom, is quashed and set aside. Consequence to follow.
8. Stay application and pending application(s), if any, also stand disposed of.
