GP FOR HIGHER EDUCATION (AP) The Court made the following: 39 VS,J W.P.Nos.1024 of 2018 & batch COMMON ORDER: All these petitions are filed claiming same relief by different petitioners, but the issue involved in these petitions is one and the same. Therefore, I am of the view that it is appropriate to decide all the petitions by way of this common order. Aggrieved by the action of the respondent authorities in not paying minimum time scale and other benefits to the petitioners attached to the post of Assistant Professor as per revised pay scales applicable to regular Assistant Professors working under the respondent universities, in terms of GO.Ms No.38, Higher Education (UE) department, dated 23.06.2016, these writ petitions are filed. 2. All the petitioners herein were appointed as Assistant Professors in their respective departments on contract basis in between 2006 and 2018 in the respondent universities by duly following the procedure prescribed for making regular appointments. All the respondent universities are governed by the University Grants Commission Act, 1956 as well as Andhra Pradesh Universities Act, 1991. The University Grants Commission has power and authority to supervise the functioning of the respondent universities with regard to maintaining higher standards in higher education and consequentially, it can also fix the salary with an objective of providing sufficient remuneration to the teaching staff. From time to time, the University Grants Commission issued various instructions to respondent universities to pay minimum time-scale to even the teaching 40 VS,J W.P.Nos.1024 of 2018 & batch staff who were appointed on contract basis or temporary basis as staff gap arrangement, pending regular recruitments. 3. The Government of Andhra Pradesh, vide G.O.Ms.No.38, Higher Education (UE) department, dated 23.06.2016 implemented the Regulations of the University Grants Commission, 2010 as per which, the minimum basic pay of Assistant Professor is Rs.21,600/- and further, they are entitled for dearness allowance @132%, however, the petitioners are not being extended the said benefit. It is the case of the petitioners that though the Hon‟ble Apex Court in State of Punjab & ors., Vs. Jagjit Singh and ors.,1, held that all the temporary employees would be entitled to draw wages at the minimum of the pay-scale grade, in the regular pay scale extended to regular employees holding the same post, the respondent universities are not paying the minimum of the time scale and other benefits in the scale extended to regular Assistant Professor to the petitioners in terms of G.O.Ms.No.38, dated 23.06.2016. Hence, these writ petitions are filed. 4. When these writ petitions came up for admission, this considering the principle of law laid down by the Hon‟ble Apex Court in State of Punjab & ors., Vs. Jagjit Singh and ors., passed an interim order directing the respondent universities to grant minimum time scale of pay to the petitioners if they are found to be discharging the same duties 1 (2017) 1 SCC 148 41 VS,J W.P.Nos.1024 of 2018 & batch and responsibilities attached to the post of Assistant Professor and qualified to hold the regular post. 5. The respondent universities have filed their respective counter affidavits along with vacate stay petitions in all these writ petitions contending that the petitioners, who were appointed as Assistant Professors on temporary/contract basis, cannot be paid the minimum of time scale of pay applicable to a regular Assistant Professor and that the G.O.Ms.No.38, dated 23.06.2016 relied upon by the petitioners is in no way applicable to them. Hence requested to dismiss all the writ petitions and to vacate the interim orders. 6. Heard Sri. P.V. Krishnaiah, Sri. T. Balaji, Sri. Chilamkuri Hanumantha Rayudu and Mrs. A.V.S. Laxmi, learned counsel for the petitioners; learned Government Pleader for Higher Education and all the learned Standing Counsel for the respondent Universities. 7. During the course of arguments, though learned counsel on either side have contended strenuously on several aspects, it is brought to the notice of this Court that the Government of Andhra Pradesh, vide G.O.Ms.No.2, Finance (HR.I – PLG & Policy) department, dated 06.01.2025 ordered the following with regard to the remuneration and other benefits payable to contract employees: “A. Payment of Minimum of Time Scale (MTS) to the Contractual employees engaged in the Government Departments, Universities and Societies: The Minimum of Time 42 VS,J W.P.Nos.1024 of 2018 & batch Scale (MTS) shall be applicable to those contract employees in Government Departments, Universities and Societies appointed against vacant sanctioned posts and for those who have been appointed by the specific Government orders issued with the concurrence of Government in Finance Department. The remuneration (minimum of time scale) to the contractual employees shall be governed by the following conditions: a)The remuneration extended shall form an all-inclusive consolidated monthly payment for all purposes. b) No other allowances shall be paid. c) No other increase in any form like annual grade increments, etc., shall be admissible on the above consolidated monthly remuneration equivalent to the Minimum of Time Scale. d) The extension of minimum of time scale is applicable to those contractual employees who have been appointed against vacant sanctioned posts and for those who have been appointed by the specific Government orders have been issued with the concurrence of Government in Finance department. e) The departments shall pay utmost attention to the conditions as referred to above, while extending the remuneration (minimum of time scale) to the personnel working on contractual basis under their administrative control. f) The Minimum pay of Time Scale (MTS) shall not apply to contract employees who are engaged for a particular project or scheme and not in the regular sanctioned vacant post since those employees working on these projects are often employed on different terms and conditions of employment and their salaries may be determined by the specific project/scheme‟s budget, and the funding agency‟s guidelines. g) The MTS shall also not be applicable to those contract employees who were appointed by an order issued without the concurrence of Government in Finance Department. h) These orders shall not apply to the Consultants/Advisors/OSDs and those appointed on specific consolidated pay, working on contractual basis in Government Departments. I)These orders shall not apply to the employees working on outsourcing basis. 43 VS,J W.P.Nos.1024 of 2018 & batch j) No further recruitment shall be made on contractual basis without prior approval of the Government in Finance Department. For any appointment in deviation, disciplinary proceedings shall be initiated against the appointing authorities and severe penalties under A.P.C.C.A. Rules, 1991, will be initiated and the appointments made irregularly shall be cancelled. The salary bills of such irregular appointees shall not be admitted in the audit.” 8. The Hon‟ble Supreme Court of India, in State of Punjab & ors., Vs. Jagjit Singh and ors., (referred supra) at paragraph No.55 held as under: “55. …We affirm the decision rendered in State of Punjab v. Rajinder Kumar „State of Punjab v. Rajinder Kumar, 2010 SCC OnLine P&H 13009], with the modification that the employees concerned would be entitled to the minimum of the pay scale, of the category to which they belong, but would not be entitled to allowances attached to the posts held by them.” 9. The Apex Court, considering the expression „pay‟ in Tej Singh and Others v. Sarvesh Kaushal and Ors.,2, held as under in its order dated 04.05.2016: “After hearing learned counsel for the parties, we are of the opinion that the expression “minimum of the pay” mentioned in paragraph 22 is intended to mean not only the basic pay + grade pay, but also the dearness allowance that comes along with the basic pay and grade pay. This is in the context of the view expressed by this Court denying regular appointments to the petitioners, while taking into consideration the fact that the services of the Home Guards are used during an emergency and for other purposes and at the time of their duty they are empowered with the power of police personnel. 2 Contempt Petition (Civil) Nos.699-700 of 2015 44 VS,J W.P.Nos.1024 of 2018 & batch Accordingly, we make it clear that the word “minimum of the pay” used in paragraph 22 of the judgment and order dated 11th March, 2015 means the basic pay + grade pay + dearness allowances + washing allowance.” 10. It is made clear that once the petitioners are held entitled to the benefit of the Minimum of Time Scale (MTS), their remuneration shall necessarily be determined in accordance with the law laid down by the Hon'ble Supreme Court. As referred supra, in State of Punjab & Ors. v. Jagjit Singh & Ors., the Apex Court held that similarly situated employees are entitled to the minimum of the pay scale applicable to the post. The expression "minimum of the pay" was subsequently clarified in Tej Singh and Others v. Sarvesh Kaushal and Others to include not only the basic pay and grade pay, but also the dearness allowance and other admissible components. Therefore, the petitioners are entitled to payment of the Minimum of Time Scale including the applicable dearness allowance as explained by the Hon'ble Supreme Court. 11. Considering the fact that the petitioners were selected through a regular selection process after due notification on contract/temporary basis, the respondent universities are directed to grant all the petitioners the Minimum of Time Scale including the dearness allowance, attached to the post of Assistant Professor, with effect from the date of issuance of G.O.Ms.No.2, Finance (HR.I – PLG & Policy) department i.e., 06.01.2025. 45 VS,J W.P.Nos.1024 of 2018 & batch The said process shall be completed within a period of three (3) months from the date of receipt of a copy of this order. 12. Accordingly, with the above directions, these writ petitions are allowed. There shall be no order as to costs.
