The petitioner is apprehending his arrest in connection with N.D.P.S. Case No.06 of 2025 arising out of Manatu P.S. Case No.12 of 2025, registered for the offence under Sections 8B, 18B and 29 of the N.D.P.S. Act and Section 33 of the Indian Forest Act, pending in the Court of the learned Special Judge, NDPS Act, Palamau at Daltonganj. 3. Learned counsel appearing for the petitioner submits that false allegation is made against the petitioner of cultivation of poppy plants on the forest land. She further submits that the land is not belonging to the petitioner. She then submits that the petitioner is having no criminal antecedent, as disclosed in paragraph 16 of this application. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of cultivation of poppy plants on the forest land. 5. Considering that the land is of the Forest Department and that is not belonging to the petitioner and the petitioner has got no criminal antecedent, as disclosed in paragraph 16 of this application and in that view of the matter, ( 2026:JHHC:11205 ) -2- A.B.A. No. 1746 of 2026 the petitioner is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions as the learned Court may deem fit and proper. 6.
