Heard the learned Senior Counsel Mr. A M Bora assisted by Mr. D Das, appearing for the petitioner. Also heard Mr. K Baishya, learned Additional Public Prosecutor appearing for
Page No.# 2/2 the State of Assam as well as Mr. A R Mondal, the learned counsel appearing for the respondent No.2.
2. It is submitted that in this case, police has filed the charge sheet.
3. This is an application under Section 482 of the BNSS, 2023, whereby the petitioner has prayed for grant of pre-arrest bail in respect of Golakganj P.S. Case No. 241/2025 (corresponding to G.R. Case No.1417/2025).
4. From the case record, it appears that the victim girl was a consenting party to the act of the petitioner.
5. I have considered the submissions made by the learned counsel of both sides in the light of the materials available before this Court.
6. This Court is of the opinion that the present petitioner does not deserve to be detained in custody.
7. Therefore, the bail application of the petitioner is allowed.
8. The petitioner is directed to appear before the trial court within next 15 days from today. On his appearance, the petitioner, Safikul Rahman shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the arresting authority.
9. With the aforesaid direction, the anticipatory bail application stands disposed of.
