Roy Mr. Sutanu Chakraborty ..for the State Affidavit of service filed by the petitioner is taken on record. None appears for the Panchayat despite service. Learned counsel for the petitioner submits that the Paschimpara Gram Panchayat is constructing a pacca road under the Pathasree Scheme by encroaching upon the petitioner’s land without acquiring the same. The petitioner seeks to submit a comprehensive representation before the concerned authority in this regard for consideration of the issue. Such liberty is granted. The petitioner shall submit a comprehensive representation ventilating his grievance before the Block Development Officer, Goghat II Development Block, being the 6th respondent herein, within a fortnight from date. The 6th respondent is directed to consider and dispose of the representation within six weeks from the date of receipt thereof upon granting reasonable opportunity of hearing to the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
