Heard the learned counsel appearing on behalf of the parties.

Learned counsel for the petitioner submits that the petitioner is in custody since 17.05.2024 in connection with S.T. No. 185 of 2024 arising out of Latehar P.S. Case No.82 of 2024, registered under Sections 304B/201 of the Indian Penal Code, now pending in the court of learned Additional Sessions Judge-II, Latehar.
3. The learned counsel for the petitioner submits that the bail application of the petitioner was earlier withdrawn vide order dated 22.07.2025 in B.A. No. 1812 of 2025.
4. The learned counsel submits that the petitioner is the husband of the deceased and the post mortem report is not supporting the allegation. However, during the course of hearing, it transpired that 2 prosecution witnesses had already been examined out of 11 as on
20.01.2026.
5. The learned counsel for the State has opposed the prayer and submitted that the trial can be expedited.
6. After hearing the learned counsels for the parties and considering the direct allegation against the petitioner, this Court is not inclined to enlarge the petitioner on bail.

7. However, the State is directed to ensure that the remaining witnesses are promptly produced before the learned court.
8. The learned counsel for the State is directed to communicate this order to the Superintendent of Police of the concerned district and also to the Director, Prosecution to ensure compliance.
9. Let a copy of this order be communicated to the learned court concerned through “FAX/email”.
