JUSTICE R.K. PATTANAIK Order No. ORDER 16.01.2026 02. 1. Heard learned counsel for the petitioner and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Ghasipura P.S. Case No.204 of 2018 corresponding to G.R. Case No.337 of 2018 pending in the court of learned S.D.J.M., Anandapur on the grounds stated. 3. Perused the FIR as at Annexure-1. The chargesheet is already filed, a copy of which is in record for the Court’s perusal. It has been alleged therein that there has been misappropriation of loan amount alleged against the petitioner and others. It is submitted to the Court that the husband of the petitioner is on bail pursuant to the Court’s order in ABLAPL No.5742 of 2025, a copy of which is at Flag-C. Recorded the objection of the State. The petitioner alleged to have misappropriated the money from others towards loan being the President of an SHG. In fact, the chargesheet reveals an amount of Rs.5 lac was misappropriated by the petitioner with other accused persons. Learned counsel for the petitioner submits that there have been some deposits made in the meantime. Considering the above facts and submission of learned counsel for the respective parties and release of the petitioner’s husband by order dated 22nd October, 2025 in ABLAPL No.5742 of 2025, this Court is of the view that she should not be granted pre-arrest bail, however, directed to surrender before the learned court below for being released on bail with conditions by the following order. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders within fifteen days from today before learned S.D.J.M., Anandapur in connection with G.R. Case No.337 of 2018 corresponding to Ghasipura P.S. Case No.204 of 2018, she shall be released on bail upon furnishing a bail bond of Rs.50,000/-(rupees fifty thousand) with one solvent surety for the like amount with conditions imposed only upon verification with regard to her claim regarding the deposits made for an amount of Rs.2 lac towards repayment. 6.
