Learned counsel for the petitioner submits that the petitioner is in custody since 29.08.2025 in connection with Sessions Trial Case No.20 of 2026 arising out of Kathikund P.S. Case No.25 of 2025, corresponding to G.R. Case No.859 of 2025, registered under Sections 140(3), 351(2), 103(1) & 238 of the Bhartiya Nyaya Sanhita, 2023, cognizance has been taken for the offences under Sections 140 (3), 351 (2), 103 (1), 238, 3 (5) of BNS 2023, now pending in the court of learned Additional Sessions Judge – III, Dumka. 3. The learned Senior counsel for the petitioner submits that the petitioner has been falsely implicated in this case and as per the F.I.R., the allegation was against one Babu Mohli, but ultimately the petitioner has been made an accused in this case. He has submitted that as per the post mortem report, the cause of death is shown as lacerated wound near the neck region and apart from confessional statement, there is nothing against the petitioner. 4. The learned counsel for the State has opposed the prayer and referred to paragraph 73 of the case diary that the body of the victim 2026:JHHC:10357 2 was recovered at the instance of the petitioner, which was put into the well with bricks. 5. After hearing the learned counsels for the parties and considering the fact that the body was recovered on the basis of confessional statement of the petitioner, this Court is not inclined to enlarge the petitioner on bail. Hence, this bail application is rejected. 6. Let a copy of this order be communicated to the learned court concerned through “FAX/email”. (Anubha Rawat Choudhary, J.)
