ORAL ORDER
The captioned petition is filed by accused No.1 seeking quashing of the proceedings pending in Crime No.99/2024 registered by the respondent No.1/Malleshwaram Police for the offences punishable under Sections 34, 406, 419, 420, 465, 467, 468 and 471 of IPC pending on the file of the III Additional Chief Judicial Magistrate Court, Bengaluru.
2. Today, a compounding application is filed duly signed by the complainant and the accused. As per the joint petition, the present petitioner/accused No.1 has paid an amount of Rs.20,00,000/- by way of demand draft which is handed over in the open Court to the

complainant. On a query, respondent No.2 has confirmed the settlement and has acknowledged receipt of the aforesaid amount.

In view of the amicable settlement arrived at between the parties and also taking note of the fact that the proceedings against the other accused have already been quashed by this Court in Criminal Petition No.10453/2024 c/w Criminal Petition No.8337/2025, this Court is of the considered opinion that interference is warranted. Though the offence under Section 420 of the IPC is non-compoundable, the dispute between the parties appears to be essentially civil in nature. It is also not in dispute that accused No.1 has settled the matter by repaying a sum of Rs.20,00,000/-, which has been voluntarily accepted by the complainant, who is present before this Court. Therefore, in order to secure the ends of justice and to prevent abuse of the process of law, this Court deems it appropriate to exercise the inherent

jurisdiction under Section 482 of the Cr.P.C. (corresponding to Section 528 of the BNSS, 2023).
4. For the foregoing reasons, this Court proceeds to pass the following:
ORDER (i) Petition is allowed; (ii) The proceedings pending in Crime No.99/2024 registered by the respondent No.1/Malleshwaram Police for the offences punishable under Sections 34, 406, 419, 420, 465, 467, 468 and 471 of IPC pending on the file of the III Additional Chief Judicial Magistrate Court, Bengaluru, are quashed insofar as petitioner is concerned.
