No.186 of 2025 arising out of Pipra P.S. Case No. 07 of 2025 corresponding to G.R. No.709 of 2025 for the offence registered under Sections 123, 80, 3(5) of Bhartiya Nyaya Sanhita, 2023 pending in the Court of learned Additional Sessions Judge-V, Palamu, is pressed into motion. It is submitted by the learned senior counsel on behalf of petitioner that in order to make out an offence of dowry death, principal ingredient of unnatural death in reference to a dowry demand within seven years should be present. Here, there is no evidence with regard to unnatural death of the deceased. As per the FIR, allegation is that the deceased was forcibly administered poison, resulting in her death. The post-mortem examination report does not refer to any injury on the body of the deceased. Learned A.P.P. opposed the bail petition. In this case, viscera was preserved and sent for Forensic Science Laboratory for examination. The report was called for which has been received in which it has been stated that no metallic, alkaloidal, pesticidal, volatile or non- volatile poisons could be detected in the portions of viscera. Under the circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
