Mr. Rajdeep Mazumder, Sr. Adv., Mr. Moyukh Mukherjee, Mr. Pritam Roy, Ms. Sagnika Banerjee
... For the Petitioner.
Mr. Debasish Roy, Ld. PP, Mr. Rudradipta Nandy, Ld. APP, Mr. Sanjoy Bardhan, Mr. Amanul Islam
... For the State.
Mr. Navanil De, Mr. Soumya Nag, Mr. Aditya Tiwari, Mr. Subhrajit De, Mr. Shoumilya Mazumder, Mr. Ritwik Mondal
... For the de facto complainant.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for 103 days. According to the learned advocate, there was property dispute between the petitioner and the de facto complainant. As such, the petitioner has been falsely roped in. Learned advocate appearing for the de facto complainant opposes the prayer for bail.
2 Learned advocate appearing for the State opposes the prayer for bail and draws the attention of the Court to the medical reports as well as the statement of the two injured persons. Having regard to the statement of the injured, I am of the view that at this stage, it would be premature to release the petitioner on bail taking into account the nature and manner in which the alleged offences were committed. Learned Trial Court will prioritize the examination of the two witnesses immediately after the charges are framed. At this stage, the prayer for bail of the petitioner is rejected. Petitioner would renew his prayer for bail after the evidence of two injured witnesses is over. The application for bail, being CRM (M) 2626 of 2025, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
