01. This petition is disposed of at its very inception stage without indulging in an adjudication on merits in any sense of manner by directing the civil court of learned 2nd Civil Subordinate Judge, Jammu, to undertake exercise for framing of issues in the civil suit given the fact that the written statement from the end of the petitioners, who figure as defendants, has taken place and the petitioners as defendants are agitating about the very maintainability of civil suit before the civil court by Serial No. 131 Supplementary List-1

purported reference to the nature of the suit relief claimed by the respondents.
02. Let framing of the issues take place by or before 30.04.2026 whereupon, in case of framing of any preliminary issue warranting adjudication on the basis of
submissions from both sides. Let said adjudication take effect accordingly without wastage of time in adjournments.
