The petitioner had made an application for grant of one permanent stage carriage permit on 30.04.2025 vide application no. WB- 250430P2276761. A meeting was held by the respondent no.2 declaring the petitioner to be the successful grantee. In pursuance of a board meeting held on 20.05.2025, an offer /Memo No. WB2025-OL/SC-0878A dated 20.06.2025 was issued, by giving a validity for a period of 180 days for grant of one permanent stage carriage permit for a period of five years. The said application still remains pending for consideration. 2
3. Main grievance of the petitioner is to correct the seat capacity of 34 instead of 31 and the sleeper capacity in place of ‘0’ as 15. The petitioner submits that already the period of 180 days had expired on 17th of December, 2025, and the vehicle was accordingly produced before the date of expiry. 4. A representation dated 23rd December, 2025 has been made to the respondent no.2 for the extension of the validity period of the offer letter, since the same has already been expired on December 17, 2025. 5. Learned counsel for the State submits that since the offer letter has already expired, a fresh application be made for grant of the permanent stage carriage permit (inter-State permit). 6. Heard the parties and on the basis of the available materials on record, I am of the considered view that the petitioner being a successful candidate, had incurred huge expense for purchasing the vehicle. Due to the fault of the authority concerned, the petitioner shall not languish or be deprived of from availing the benefit of plying the vehicle in the route in question. 7. The respondent no.2 is directed to consider the representation dated 23.12.2025 being annexure
3 p-7 at page-40 to the writ petition within a period of three weeks by passing a reasoned order in accordance with law upon affording an opportunity of hearing to the petitioner and communicate such decision preferably within a week thereafter. 8.
With the above observations and directions, the writ petition, WPA 86 of 2026 stands disposed of without going into the merits of the case. 9. However, it is made clear that if the authority concerned finds the grievance is legally viable and permissible, the authority shall forthwith correct and amend the offer/Memo dated 20.06.2025 extending for a further period of 14 days or issue a fresh offer letter by mentioning the correct seat number and the head of the sleeper capacity within the time framed by this Court. 10.
