Musior Rahaman …for the State On prayer of the petitioner, liberty is granted to implead the Director of Pension, Provident Fund and Group Insurance, Government of West Bengal and Treasury Officer, Bankura as respondent nos. 7 and 8 in the writ petition. The cause title of the writ petition be amended accordingly. Since the State is represented, service of notice upon the added respondents is dispensed with. Affidavit of service filed by the petitioner is taken on record. None appears on behalf of the State respondents despite service. Mr. Mir Anuruzzaman, learned advocate, who usually appears on behalf of the State and is present in Court today, is requested to represent the State in this matter along with a junior of his choice. The concerned authority is requested to regularise the appointment of Mr. Mir Anuruzzaman and his junior in this matter. The petitioner is directed to serve a copy of this application along with annexure thereto upon Mr. Mir Anuruzzaman in course of this day. Heard learned counsels for the parties. The petitioner was working as Deputy Secretary of Gangajal Ghati Panchayat Samity and superannuated on May 31, 2022. Despite completing all related formalities within due time, the gratuity amount was disbursed in favour of the petitioner on March 02, 2023. The petitioner has prayed for interest on the gratuity amount due to delay in disbursal of the same. Upon consideration of the submission made on behalf of the parties and material on record, the Director of Pension, Provident Fund and Group Insurance, Government of West Bengal and the Treasury Officer, Bankura, being the 7th and 8th respondents herein, are directed to pay interest to the petitioner @8% per annum on the gratuity amount calculated from June 01, 2022 till the date of actual payment of the amount. Such payment be made within two months from the date of communication of this order. With the above observation and direction, the writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. 2 Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
