Bhattacharya, G.A. HON’BLE JUSTICE DR. T. AMARNATH GOUD 16.02.2026 Order [1] Heard Mr. P. Roy Barman, learned senior counsel assisted by Mr. D. Paul, learned counsel appearing for the petitioner. Also heard Mr. Kohinoor N. Bhattacharya, learned G.A. appearing for the State respondents. [2] The instant petition has been filed under Article 226 of the Constitution of India seeking the following reliefs: “i. Issue Rule upon the Respondents to show cause as to why writ in the nature of Mandamus and/or order/orders and/or direction/ directions of like nature shall not be issued whereby directing the Respondents to consider the allotment of the Ishanpur F.P. Shop No.2, in favour the Petitioner, in terms of the Memorandum, dated, 04.12.2006. ii. Issue Rule upon the Respondents to show cause as to why writ in the nature of Mandamus and/or order/orders and/or direction/ directions of like nature shall not be issued whereby directing the Respondents to consider the iii. Issue Rule upon the Respondents to show cause as to why writ in the nature of Mandamus and/or order/orders and/or direction/ directions of like nature shall not be issued whereby quashing and cancelling the Order, dated, 08.01.2026, issued by the SDM Mohanpur, directing handing over and taking over charge of Ishanpur F.P. Shop No.2, between Abhijit Debnath and Bairagi Para F.P. Shop under Daldali Lamps on 13.01.2026. iv. Make the rules absolute. v. Call for records…………..” [3] It is seen from record that the petitioner submitted a representation on 27.01.2026 to the respondents raising her demand. Thereafter, the Addl. Secretary & Director, Food, CS & CA, Tripura by a letter dated, 01.02.2026, communicated to the SDM Mohanpur, to inform him, that, application from the petitioner has been received for awarding F.P. Shop Dealership License in her favour and the SDM was asked to take necessary action in the matter. But, it is contended on behalf of the petitioner that, the case of the petitioner is still pending before the concerned authority. [4] In view of the above, without going into the merits of the case, this Court directs the concerned respondent(s) to consider the case of the petitioner in the light of her representation dated 27.01.2026 and the inter- departmental communication dated 01.02.2026 in accordance with law as expeditiously as possible preferably, within a period of two months from the date of receipt of the copy of this Order.
