Hon'ble Shri Justice Sachin Singh Rajput, Order on Board 15.04.2025 1) This appeal under Section 173 of Motor Vehicles Act, 1988 (for short “ MV Act”) has been filed by the appellant/claimant being aggrieved by the award dated 13.05.2020 passed in Claim Case No. 228/2020 by the learned 1st Additional Motor Accident Claims Tribunal, Raipur District- Raipur (CG) (for short learned Tribunal). 2 by the rash and negligent driving of respondent no. 1/driver and owner of the offending vehicle i.e. Car bearing Registration No. C.G.07-AV-7701. 2) Learned counsel for the appellant submits that the amount awarded by learned tribunal is on the lower side which may be suitable enhanced. 3) Learned counsel for the respondent No. 2 supports the award and submits that just compensation has been awarded. 4) I have heard learned counsel for the parties and perused the record. 5) On perusal of record & evidence available, this Court deems it fit to award further sum of Rs. 50,000/- to make the compensation just. 6) Respondent No. 2 is directed to deposit an additional sum of Rs. 50,000/- within a period of 60 days from today. 7) Appeal thus allowed in part.
