The grievance of the petitioner is that respondent No.2-Tahsildar, Devanahalli Taluk, has refused to accept the unregistered partition deed executed between the family members on 12.07.2016 and enter the name of the petitioner in the revenue records. Learned Additional Government Advocate submits that if the petitioner is placing reliance on an unregistered partition deed, the Tahsildar has rightly rejected the request made by the petitioner, since based on an - 3 - HC-KAR NC: 2026:KHC:20652 WP No. 10278 of 2026 unregistered instrument where transfer of a property valued more than ₹100/- is allotted to the share of the petitioner, the same requires registration in terms of Section 17 of the Registration Act, 1908. 3. Accepting the submissions of the learned Additional Government Advocate, the writ petition stands disposed of reserving liberty to the petitioner to present a registered instrument before the Tahsildar to enable the Tahsildar to enter the name of the petitioner in the revenue records.
