For issuance of an appropriate writ(s) / order(s) /direction(s) in the nature of certiorari for quashing of the Notification as contained in Memo No. 18/Aarop-01-55/2022 97(18) dated 13.03.2024 (Annexure-7) issued under signature of Joint Secretary, Department of Health, Medical Education and Family Welfare, Government of Jharkhand whereby and whereunder the petitioner has been inflicted with punishment of withholding of five (5) annual increments with cumulative effect. ii. For issuance of an appropriate writ(s) / order(s) /direction(s) in the nature of certiorari for quashing of the order as contained in Memo No. 18/Aarop-01-55/2022- 251(18) dated 04.07.2024 (Annexure-9) issued under the signature of Joint Secretary, Department of Health, Medical Education and Family Welfare, Government of Jharkhand whereby and whereunder the Appeal preferred by the petitioner has been rejected. 2026:JHHC:10799 2 iii. Upon quashing of the aforesaid orders a further writ(s) / order(s) / direction(s) to release the consequential benefits.; 2. During the pendency of the writ application, an interlocutory application being I.A. No. 3610 of 2026, has been filed praying therein to dispose of the writ application in the light of order dated 25.02.2025, passed in W.P.(S). No. 958 of 2025 (Preetish Pronoy Vrs. The State of Jharkhand & Ors.). 3. It has been argued by learned counsel for the petitioner that the allegation levelled against the present petitioner is same and similar to the petitioner in W.P.(S). No. 958 of 2025 and further, the said writ application was allowed on the ground that no oral evidence was laid in order to prove the charges against the petitioner. 4. It has been further stated that the respondents have already implemented the order by redressing the grievance of the petitioner in W.P.(S). No. 958 of 2025. Accordingly, the same relief may also be granted to the present petitioner. 5. This argument of the petitioner’s counsel could not been controverted by the learned counsel representing the respondents. 6. Accordingly, in the light of the finding given in para-13 of the order dated 25.02.2025, passed in W.P.(S). No. 958 of 2025, the instant writ application also stands allowed in the same line. 7. Accordingly, impugned orders dated 13.03. 2024 (Annexure-7) and dated 04.07.2024 (Annexure-9) are quashed and set aside.
