Issue appropriate directions to the Respondent No.2 to issue a passport to the petitioner for a duration of period of 10 years or such period not less than 3 years this Hon'ble Court may postulate to enable the petitioner to undertake employment in Dubai (U.A.E.) in the wake of the requirement postulated for his work as such directions would be required in wake of the embargo contained in section 6(2) (f) of The Passports Act 1867 coupled with the Registrar Notification No. GSR 570 (E) which mandates that in the event that a person who 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:2966 seeks issuance of passport is facing criminal prosecution, a specific order by the court ought to be obtained; 2. Call upon Respondents No. 3 & 4 to produce the records of the Case No. Police Challan/473/2020 arising out of FIR No. 105 dated 7.5.2019 registered under Sections 279, 337 and 338 IPC at Police Station Shimla West Shimla (Annexure P-1) pending in the court of Addl. Chief Judicial Magistrate-II Shimla wherein a compromise/settlement has formally been arrived at between the purported victims and the petitioner relating to a minor road which now sought to be accident quashed/terminated. 2. Having heard learned Counsel for the parties, this petition is disposed of with the observation that let the application of the petitioner for grant of Passport be dealt with in accordance with law and appropriate decision be taken thereupon within a period of two weeks from today. In the course of consideration of the application of the petitioner for the issuance of Passport, his request for grant thereof for a period of three years or more be also considered sympathetically in accordance with law.
