JUSTICE R DEVDAS ORAL ORDER Learned Additional Government Advocate takes notice for respondent Nos.1 to 5. Notice to respondent No.6 is not necessary for the following reasons. 2. It is the contention of the petitioner that the petitioner's father was granted with 28 guntas of land in Sy.No.637/4 and 26 guntas in Sy.No.577 both situated at Ghattadahalli Village, Halebeedu Hobli, Belur Taluk, Hassan District in the year 2003. However respondent No.6 raised a challenge to the grant made in favour of the petitioner's father and the Assistant Commissioner allowed the appeal on 01.01.2004 while remanding the matter back to the Committee for fresh consideration in the light of the observations made by the Assistant Commissioner. The order passed by the Assistant Commissioner was confirmed at the hands of the Deputy Commissioner by order dated 21.07.2010. However till date the Committee has not reconsidered the application and therefore the prayer in the writ petition is to issue necessary - 4 - HC-KAR NC: 2026:KHC:13569 WP No. 7153 of 2026 directions to the Committee to take up the application, reconsider the same in the light of the observations made by the Assistant Commissioner, within a time frame. 3. In the light of the facts narrated herein above, it was incumbent upon the respondent No.5 - Committee to have reconsidered the application and the Committee should have passed fresh orders. 4. Consequently, the writ petition stands disposed of with a specific direction to the respondent No.4 - Tahsildar, Belur Taluk, to place before respondent No.5 - Committee the application filed by the petitioner's father within a period of 6 weeks from the date of receipt of a copy of this order. Respondent No.5 - Committee shall thereafter reconsider the application in the light of the observations made by the Assistant Commissioner in his order dated 01.01.2004 and pass necessary orders as expeditiously as possible and at any rate within a period of 2 months from the date when which the application would be placed by the Tahsildar before the Committee. - 5 - HC-KAR NC: 2026:KHC:13569 WP No. 7153 of 2026 Learned Additional Government Advocate is permitted to file memo of appearance within a period of four weeks from today.
