Learned counsel for the petitioner submits that the petitioner is in custody since 08.01.2026 in connection with Pratappur P.S. Case No. 112 of 2025 corresponding to POCSO Case No. 19 of 2026, registered under Sections 126(2)/115(2)/74/352/351(2)/351(3) & 3(5) of Bharatiya Nyaya Sanhita and under section 8/12 of POCSO Act, now pending in the court of learned Additional Session Judge cum Special Judge (POCSO) Chatra. 3. Learned counsel for the petitioner further submits that identically placed co-accused namely, Sangam Kumar Singh @ Sangam Singh has been enlarged on bail by this Court vide order dated 13.04.2026 in B.A. No. 2993 of 2026. 4. Learned counsel for the opposite party- State, on the other hand, has opposed the prayer and has submitted that though the case of the petitioner is similarly situated as that of the co-accused namely, Sangam Kumar Singh @ Sangam Singh, but the submission for grant of bail to the said co-accused was that the victim did not agree for medical examination. 5. After hearing the learned counsel for the parties and considering the fact that similarly situated co-accused has been enlarged on bail and also the fact that the petitioner has no criminal antecedent coupled with the fact that though there is an allegation that the victim suffered certain injuries but she refused for medical examination and charge-sheet has already been submitted, the 2026:JHHC:11275 2 petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/-(Rupees twenty-five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Session Judge cum Special Judge (POCSO) Chatra in connection with Pratappur P.S. Case No. 112 of 2025 corresponding to POCSO Case No. 19 of 2026, on the following conditions: (i) One of the bailors would be the present pairvikar of the petitioner. (ii) The other bailor should be his close relative. (iii) The petitioner will attend the court on each and every date and on account of even single default, the learned court shall cancel the bail bond furnished by the petitioner. (iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court. (v) The petitioner shall fully co-operate with the proceedings before the learned trial court. 6. The instant application is allowed with the aforesaid conditions. 7.
