The present acquittal appeal has been filed seeking leave to appeal against the judgment dated 06.01.2025 passed in Complaint Case No.5439 of 2019 by the learned Judicial Magistrate First Class (J.M.F.C XXX), Ranchi whereby and whereunder the learned Trial Court has acquitted the respondent No.2 for the charge under Section 138 of the Negotiable Instruments Act, 1881. 2. Section 372 Cr.P.C (now Section 413 of the B.N.S.S, 2023) clearly gives opportunity to the victim to file an appeal before the Trial Court. Hence, no leave to appeal is required. 3.
