IN THE HIGH COURT OF ORISSA AT CUTTACK W.P.(C) No.2787 of 2026 CORAM: JUSTICE SASHIKANTA MISHRA ORDER 13.03.2026 1. This matter is taken up through hybrid mode. 2. As directed, learned State counsel has obtained written instructions from the Tahasildar, Khordha vide letter dated 12.03.2026. It is stated that the property being a joint property, the demarcation was completed but the property is subject matter of an appeal in R.F.A. No.6 of 2025 pending before the First Additional District Judge, Khordha. 3. It is stated since the matter is sub-judice and taking into consideration the objections presented by the objector, the report is kept pending until the order is passed in the RFA. This is an unacceptable plea taken by the Tahasildar. 4. The pendency of the first appeal has no bearing on the demarcation case. 5. It goes without saying that ultimately the civil Court decree shall prevail. Till such time, the report of demarcation, if actually completed should be supplied to the petitioner. 6.
