This criminal miscellaneous petition has been filed at the instance of the petitioners for restoration of CrMP No. 4031 of 2023 to its original file. The petitioner in person submits that the CrMP No. 4031 of 2023 was dismissed for non-prosecution vide order dated 08.12.2025. The petitioner in person further submits that due to inadvertence and lack of information about the date of hearing, the petitioner could not appear in the court, when the case was called out, which resulted in dismissal of CrMP No. 4031 of 2023. The petitioner in person, further submits that he has very good grounds to agitate in this case and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that CrMP No. 4031 of 2023 be restored to its original file. Learned Spl. P.P. has no serious objection for the prayer of restoration. Considering the facts of the case and the aforesaid submission of the petitioner in person, CrMP No. 4031 of 2023 is restored to its original file to the stage, at which, it was before its dismissal.
