THIS PETITION, COMING ON FOR ORDERS THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MRS. JUSTICE ANU SIVARAMAN & HON'BLE MS. JUSTICE TARA VITASTA GANJU ORAL ORDER (PER: HON'BLE MRS. JUSTICE ANU SIVARAMAN) This Contempt of Court case is filed alleging non- compliance of the directions issued in W.P.No.20870/2023 (S- RES). The operative part of the order reads as follows: “ORDER (a) The petition is allowed in part directing the second respondent – the Director/Commissioner of Technical Education – to consider the petitioner’s request for grant of Selection Grade Lecturer Pay Scale, IV Pay Band and 7th AICTE Revised Pay Scale from the corresponding effective dates but subject to the Disciplinary Authority’s order dated 07.09.2012. (b) The second respondent shall accordingly consider and compute the benefits that would be admissible to the petitioner within a period of three - 3 - HC-KAR NC: 2026:KHC:22359-DB CCC No. 1333 of 2024 (3) months from the date of receipt of a certified copy of this order. (c) The petitioner is reserved with liberty to file a fresh representation with a certified copy within four (4) weeks from the date of receipt of the order.” 2. The learned counsel for the complainant submits that the directions have not been complied with in full. A compliance affidavit has been placed on record by the learned Additional Government Advocate, contending that the benefits that have been found eligible have already been ordered to be paid to the complainant. However, it is submitted that in respect of certain claims of the complainant, the complainant is found ineligible for the same. It is further submitted that in respect of the benefits which have not been granted to the complainant, a writ petition has been filed by the complainant, which is pending as W.P.No.17371/2025. 3. Having considered the contentions advanced, we are of the opinion that the benefits which are granted to the complainant after considering the claims, have to be released to the complainant in full. - 4 - HC-KAR NC: 2026:KHC:22359-DB CCC No. 1333 of 2024 4. However, with regard to the benefits that he is not found entitled to, we are of the opinion that the matter has to be considered in the pending writ petition leaving all the contentions of the complainant open. 5. This Contempt of Court case is closed. However, it is made clear that the amounts to which the complainant is found eligible shall be paid to the complainant forthwith, without further delay. 6.
