Mr. Shubhang Dobhal, learned counsel for the petitioner. 2. Mr. Himanshu Sain, learned A.G.A. for the State. 3. By the instant petition the petitioner is praying for the following reliefs: i. Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent to place before this Hon’ble Court the progress report on the complaint dated 25.04.2026 and 04.05.2026 filed by the petitioner. ii. Issue a writ, order or direction in the nature of mandamus commanding and directing the SSP Dehradun and SHO Raipur, District Dehradun (respondent no. 2 and 3) to take action on the complaint dated 25.04.2026 and reminder complaint dated 04.05.2026 of the petitioner against the private respondent. 4. It is submitted by the learned counsel for the petitioner that the petitioner filed Original Suit No. 569 of 2025 for permanent injunction, wherein, on 23.12.2025 the Civil Court grant temporary injunction, despite this, on 21.04.2026 Mr. Neeraj Bhandari and one Rajesh Ramola came on suit property with J.C.B. Machine and broken the boundary wall. 5. With regard to the aforesaid incident a complaint was also made to the S.H.O. but from the complaint it reveals that the petitioner already filed a civil suit, wherein, the temporary injunction was granted on 23.012.2025 and if there is any violation of the order of temporary injunction, the petitioner has a remedy to file an application under Order 39 2-A of CPC. 6. In such view of the matter, I do not find any substance in this matter and the same is, accordingly, dismissed. 7. The dismissal of this petition will not prejudice the right of the petitioner to avail an 2026:UHC:4363 appropriate remedy and it will not prejudice his rights also to file a petition if there is any threat to his life and liberty.
