Learned advocate appearing for the petitioner submits that the petitioner is in custody for 7 months and he has been falsely implicated in connection with the instant case. The information was furnished by this petitioner to the sister of the deceased who is the de facto complainant of the case.
Learned advocate for the State opposes the prayer for bail and submits that there was an extra marital affair of the present petitioner with the wife of the deceased which is the genesis of the motive resulting in the commission of the offence.
Having considered the present stage of the case as well as the consequences which may ensue so far as the prescribed punishment is concerned, I am of the view that this is not a fit case for granting bail.
Accordingly, the prayer for bail of the petitioner in
2 CRM(M)431 of 2026 is rejected at this stage.
