...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondents in not releasing the balance bill amount of Rs. 67,47,332/- payable to the Petitioner for the work of Providing 600mm dia DI K9 Pumping Main from Market area Pumping Station to STP at Jakkampudi under Agreement No. 29/2009-10 dated 20-08-2009 as illegal, arbitrary, unjust, and violative of Articles 14, 19(l)(g), and 21 of the Constitution of India and Consequently direct the Respondents to pay the admitted balance amount of Rs. 67,47,332/- forthwith to the Petitioner with interest at 12percent per annum from the date it fell due till the date of actual realization and to pass Counsel for the Petitioner:

ORDER:-
The learned counsel for the petitioner submits that the petitioner was entrusted with the execution of the work for “Providing 600mm dia DI K9 Pumping Main from Market area Pumping Station to STP at Jakkampudi, vide Agreement No.29/2009-10, dated 20.08.2009.
2. It is submitted that the petitioner had completed the work entrusted to him and that the competent authority of the respondents had also approved the payments due and payable to the petitioner. The respondents have also recorded the progress of the work and the amounts due and payable to the petitioner in the M-Book. It is submitted that the competent respondent authority has certified the quality of the works completed by the petitioner and has also issued a Quality Control Certificate. The forwarding slip was also prepared for release of the payments. However, the respondents are yet to release the amounts due and payable to the petitioner.
3. Heard the submissions of the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development Department, Sri S.V.S.S.Sivaram, learned Standing Counsel for the respondent Corporation, and the learned Assistant Government Pleader for Finance and Planning.
4. During the course of hearing, the learned Standing Counsel appearing for respondent Nos.3 to 7 submitted that the bills are admitted and that funds are awaited from the 3rd respondent general funds and that the file is being

circulated for the required approvals, soon after the release of the funds, the bills due and payable to the petitioner shall be cleared.
5. Recording the submissions, this writ petition is disposed of at the admission stage, directing the respondents to verify and release the payments due and payable to the petitioner as expeditiously as possible, preferably within a period of twelve (12) weeks from the date of receipt of a copy of this
order. There shall be no order as to costs.
Pending miscellaneous petitions, if any, shall stand closed.
