Motakabber Sk, Aged about 24 years, S/o Afsar Ali Resident of Village Momrejpur, P.O. Momrejpur, P.S. Farakka, District Murshidabad, (West Bengal). …… Petitioner Versus The State of Jharkhand …... Opp. Party --------- CORAM: HON'BLE MR. JUSTICE RAJESH KUMAR --------- For the Petitioner : Mr. Md. Nasim Akhtar, Advocate For the State : Mr.P. K. Chatterjee, Spl.P.P --------
02/Dated: 17
th April, 2026
1. Apprehending his arrest, the applicant has approached this Court for grant of privilege of anticipatory bail, in connection with Borio (J) P.S. Case No.19 of 2021, corresponding to G.R No.184 of 2021, registered for the offence under Sections 414/ 34 of the Indian Penal Code and Section 12 of the Jharkhand Bovine Animal Prohibition of Slaughter Act, pending in the court of learned C.J.M., Sahibganj.
2. It appears that earlier the prayer for anticipatory bail of this applicant has been rejected twice by this Court. It is his third attempt.
3. Successive anticipatory bail application is otherwise not maintainable. Earlier, it has already been rejected on merit.
4. It has been informed by the learned Special P.P that process under Section 82 Cr.P.C (Section 84 of the B.N.S.S, 2023) has already been issued and on that ground also, the present anticipatory bail application is not maintainable.
5. Accordingly, the present anticipatory bail application is, hereby, dismissed as infructuous.
