The petitioner has been made accused in connection with S.T. Case No. 88 of 2025 arising out of Chandil ( Kapali) P.S. Case No. 259 of 2024 corresponding to G.R. Case No. 80 of 2025 initially registered for the offences punishable under Sections 103 (1) of the B.N.S., 2023 and subsequently charges for the offences punishable under section 103(1)/61 (2) of the B.N.S, 2023 and Section 25 (1-B) a/26/27/35 of the Arms Act has been framed. It is submitted by the learned counsel for the petitioner that this is the third journey of the petitioner with the prayer for regular bail and earlier the prayer for regular bail of the petitioner was rejected twice as withdrawn. It is next submitted that the fresh ground is that in the meanwhile four witnesses have been examined and none of them have stated anything against the petitioner. It is further submitted that the allegations against the petitioner are all false and the petitioner is not named in the F.I.R. and he has been implicated in the case only on the basis of the confessional statement of the co-accused Samsuddin Momin. It is then submitted that the petitioner has been in custody since 07.12.2024, as has been mentioned in paragraph no. 15 of the bail application. It is next submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. It is lastly submitted that the co-accused Samsuddin Momin with similar allegation has already been admitted to bail by this Court vide order dated 01.07.2025 in B.A. No. 2478 of 2025. Hence, it is submitted that the petitioner be admitted to bail. Learned Addl. P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Chandil, with the condition that he will co-operate with the trial of the case, furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
