No.19279 of 2026 ORDER: The present Writ Petition is filed questioning the action of the Respondents in not issuing the ‘Relieving Letter and other Certificates’ by accepting the resignation in pursuance of the request of the Petitioner dated 18.03.2026, as illegal and arbitrary. 2. The Petitioner was appointed as Ward Amenities Secretary pursuant to the Notification of 2019, dated 04.11.2019, issued by Respondent No. 3, and has been working as such. While so, a Charge Memorandum was issued by the Government vide proceedings dated 23.02.2026 under Rule 20 of the Andhra Pradesh Civil Services (Classification, Control & Appeal) Rules, 1991. In the Charge Memorandum, two charges were framed against the Petitioner. The charges pertain to the discharge of duties by the Petitioner as Ward Amenities Secretary in A.P. State Housing Corporation Limited, Y.S.R. District, on a deputation basis, wherein the allegation is that the Petitioner had recorded an advance stage of the house even though it was in a lower stage, and this led to excess payment."
3. Parallelly, the Petitioner had applied for employment as a Junior Associate in SBI Bank and after due selection, the Petitioner was issued a Letter of Offer on 24.06.2026 by the Chief Manager (HR), Administrative

Office, Kurnool. In view of the selection in SBI Bank, the Petitioner submitted a representation dated 18.03.2026 and since no action has been taken thereon, the present Writ Petition has been filed."

The learned counsel for the Petitioner seeks reconsideration of the representation dated 18.03.2026 by the Disciplinary Authority to take a lenient view taking note of the future prospects of the Petitioner in his career. 5. Learned Standing Counsel submits that as the Charge Memorandum issued against the Petitioner is pending, the Petitioner, as a matter of right, cannot seek for acceptance of resignation. 6. Heard the learned counsels. 7.
Considering the fact that the Petitioner is selected as Junior Associate in SBI Bank, the present Writ Petition is disposed of with the following directions:
i) The Respondent Authorities shall consider the representation of the Petitioner dated 18.03.2026 in accordance with the rules as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of this Order. 4
