Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioners in connection with Padwa P.S. Case No.101 of 2024 corresponding to T.R. Case No.85 of 2024 pending in the file of learned Addl. Sessions Judge-cum- Special Judge, Koraput on the grounds stated therein. 3. Perused the FIR as at Annexure-1. The petitioner had earlier approached this Court in ABLAPL No.14750 of 2024 and it was disposed of on 23rd December, 2024 with a direction for him to surrender before the learned court below seeking regular bail for being considered in the light of the decision in Tofan Singh Vrs. State of Tamil Nadu (2021) 4 SCC 1, but it has not been availed of and the plea for bail is renewed. Recording the submission of learned counsel for the petitioner and objection of the State and as the petitioner was denied bail vide ABLAPL at Flag-A, this Court is not inclined to reconsider it but grants liberty to him to surrender before the learned court below with any such plea as advanced at present with the claim that the co-accused is on bail for its consideration and order on merit. 4.
