The petitioner is apprehending his arrest in connection with Naudiha Bazar P.S. Case No.107 of 2025 for the alleged offences registered under Sections 126(2), 115(2), 117(2), 109(1), 132, 351(2), 352 and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate, 1st Class, Palamau at Daltonganj. 3. Learned counsel appearing for the petitioner submits that petitioner and informant’s side are agnates and the altercation took place due to land dispute. He further submits that the allegation against the petitioner is made of assault, however, the injury on the body of the Ruby Kumari is found to be simple. He then submits that the grievous injury has been received by one Fulwas Devi 2026:JHHC:10382 --2-- A.B.A. No. 1533of 2026 pursuant to the assault made by the Krishna Yadav. He next submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.13 of the petition. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations of assault are there. 5. Considering that the main allegation of assault is against one Rubi Kumari and she has received simple injury and the grievous injury has been received by Fulwas Devi pursuant to assault made by Krishna Yadav and petitioner has got no criminal antecedent as disclosed in paragraph No.13 of the petition and in that view of the matter the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
