B SARMA(C.G.C.) BEFORE HONOURABLE MR. JUSTICE SOUMITRA SAIKIA ORDER 20.05. 2026 Heard Mr. D. Borah learned counsel for the petitioner. Also heard Ms. B. Sarma, learned CGC for the Respondents. 2. The petitioner is aggrieved by the impugned Guwahati Service Order No. 19/2026, whereby the petitioner has been transferred from IOC Guwahati to SBSS, Salakati, Kokrajhar. The grievance of the petitioner is that she is the sole caregiver to her aged parents, who are suffering from various ailments and that matrimonial prospect are also being explored by the petitioner and her relatives. In view of these circumstances, the petitioner seeks a deferment of the transfer order at least for a period of one year. 3. Defer the ground is that among the choices which she had submitted, her first choice was OPS Noonmati, where sufficient vacancies are available, but the same was not considered and instead she was transferred to SBSS, Salakati, under the District of Kokrajhar. Under such circumstances, the petitioner is before this Court on 13.05.2026. The learned counsel for the petitioner was Page No.# 3/3 granted some opportunity to complete his instructions as also the learned CGC appearing for the State. 4. Today when the matter is listed, the learned counsel for the petitioner submits that the petitioner may be permitted to file a fresh representation before the authorities concerned ventilating her grievances. 5. However, the learned CGC objects to the submissions made by the learned counsel for the petitioner. 6. Considering the submissions made by the learned counsel for the petitioner, this Court is of the view that, on the basis of humanitarian ground, the prayer made by the petitioner can be allowed. Accordingly, the petitioner is permitted to file a fresh representation, along with all relevant documents before the Inspector General, CISF, NES, Head Quarters within a period of 3 (three) working days from today. 7. Upon receipt of such representation, the concerned authorities will shall dispose of the representation by passing a speaking order and thereof serve extra copies upon the writ petitioner. 8. In the event, the Authority considers the prayer made by the petitioner, then appropriate orders shall be passed altering the impugned transfer order of the writ petitioner. 9. Let this representation be disposed of by 10.06.2026. 10. Till the next date fixed, the petitioner’s release order shall not be issued. JUDGE Comparing Assistant
