Biswas for the petitioner Niron Swargiary who has filed this application under Section 483 of the BNSS, 2023 with a prayer for bail as he is behind bars since 06.04.2026 in connection with Sessions Case No. 26/2026 arising out of Dhekiajuli PS Case No. 690/2021 under Sections 376/506 of IPC R/W Section 25(1-A) of Arms Act.

3. The petitioner was absent on one day and it is submitted on behalf of the petitioner that he asked his engaged counsel to file an application and pray for adjournment. As the engaged learned counsel failed to pray for adjournment, NBWA was issued against the petitioner on 06.04.2026. However, the petitioner appeared on 29.04.2026 before the trial court and he was taken into custody and bail was not granted. Charges have already been framed against the petitioner. Now the petitioner is willing to appear before the trial court and will abide by any stringent condition imposed upon him.
6. Accordingly, the petitioner named above shall be released on bail on furnishing bail bond of Rs.50,000/- with a suitable surety of like amount to the satisfaction of the learned CJM, Sonitpur, Tezpur subject to the following conditions: i) That the petitioner shall co-operate with the trial, ii) That the petitioner shall not leave the jurisdiction of the Court without prior permission, till completion of trial.
10. On breach of any of the above conditions, the jurisdictional Court/ Eleka Magistrate is at liberty to immediately cancel the bail granted to the petitioner.
11. In terms of the above observations, the bail application stands disposed of.
