This is First anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.19/2026 registered at Police Station - Trikunda District- Balarampur Ramanujganj (C.G.) for the offences punishable under Sections 69, 351(3) of BNS, 2023. 2. Prosecution case, in brief is that a written application was submitted by the complainant, that on 05.01.2024, the applicant came to her house and forcibly raped her on the pretext of marriage at around 7:30 pm, and on the same date, he forcibly raped her several times, VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.04.13 18:05:37 +0530 2 and now the applicant is refusing to marry her and has threatened to kill her. On the basis of the said report, a case was registered against the applicant and taken up for investigation. Hence, this bail application. 3. Learned counsel for the applicant submits that the applicant is innocent and he has falsely been implicated in the present case. He would submit that the victim is a major girl, who came into contact with the applicant in 2023 and applicant made physical relation with her several times on the pretext of marriage and the applicant is refusing to marry her and has threatened to kill her. He also submits that the victim is approximately two years older than the applicant and their respective families did not approve of their marriage. Subsequently, the applicant married another woman. Thereafter, the victim lodged an FIR against the applicant. He further submits that there are counter FIR registered and investigation and trial are likely to take time, therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submits that as per the statement recorded under Section 183 of BNS of the victim, wherein she deposed that she came into contact with the applicant in 2023. The applicant made physical relations with the victim several times, thereafter, the applicant refused to marry her. Therefore, the present anticipatory bail application of the applicant is liable to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 3 6. Considering the facts & circumstances of the case, gravity of offence, submissions made by learned counsel for the parties, the allegations levelled against the applicant, statement recorded under Section 183 of the Bharatiya Nagarik Suraksha Sanhita, the victim has stated that applicant made physical relations with the victim several times on the pretext of marriage, and now the applicant is refusing to marry her and threatened to kill her, after which he married another girl, as such, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant– Deepak Kumar Yadav filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.19/2026 registered at Police Station - Trikunda District- Balarampur Ramanujganj (C.G.) for the offences punishable under Sections 69, 351(3) of BNS, 2023, is rejected.
