(Oral) Learned counsel representing the petitioners, on instructions, states that petitioner No.1 shall not press the present petition in case she is permitted to retain the accommodation, till disposal of the appeal having been filed by her against the grant of divorce decree by the competent Court of law. 2. Mr. Nimish Gupta, learned counsel representing respondents, on instructions, states that in case petitioner No.1 is ready and willing to give undertaking that as and when appeal having been filed by her is decided by the competent Court of law, she shall vacate the premises, respondents shall have no objection in permitting her to stay in the rented accommodation. 2 3. In view of aforesaid fair stand adopted by learned counsel representing respondents, petitioners herein are permitted to withdraw the present petition, with the condition that till the time appeal filed by petitioner No.1 against the decree of divorce granted by competent Court of law is not decided, she shall not vacate the rented accommodation. Ordered accordingly. Needless to say, as and when appeal is decided, petitioner No.1 shall vacate the rented accommodation, failing which she shall render herself liable for penal consequences as well as contempt of Court.
